Terrence Agtual, Hwy. 400 drive-by victim once pistol-whipped drug dealer, dumped gun
Toronto’s latest shooting homicide victim once pistol-whipped and robbed a drug dealer and violated a gun ban, the Sun has learned.
Terrence Agtual, 28, was fatally shot in the head 7 p.m. Saturday when a gunman ambushed the car where Agtual was a passenger on Hwy. 400.
Homicide Det. Sgt. Brandon Price told the Sun the shooting began when the vehicle was still on the highway, and that the victims’ car was “targeted,” although it isn’t clear if all three men inside were the intended prey.
The two others in the car were also wounded, and the driver managed to pull his Honda Accord off the highway and into a gas station at Finch Ave. W. and Jayzel Dr.
Agtual, 28, is Toronto’s 66th homicide victim this year.
Police are appealing for help to solve this crime.
Price said he doesn’t believe Agtual or his friends were involved in criminality at the time of the deadly ambush.
Agtual has a lengthy criminal record and was under a gun prohibition order stemming from an earlier conviction where he and another man robbed a pot peddler near 121 Parkway Forest Dr., near Sheppard Ave. E. and the 404 in October 2013.
Sajeev Nair and Ajjay Sidhu were two plainclothes Toronto cops investigating kidnappings in the area when they spotted Agtual and another accomplice mug the drug dealer, court heard.
Nair saw Agtual pistol-whip the dealer and called for backup “because with a gun involved, too many things could have gone wrong,” said Madam Justice Tamarin Dunnet in her 2015 judgment.
“In my view, this was a well-orchestrated plan to rob a drug dealer of a large amount of marijuana, using a tool of the trade — a loaded firearm,” said Dunnet.
“I reject Agtual’s explanation that his DNA only ended up on the gun because he held it for a few seconds before discarding it (near some bushes.)
“I find that his evidence lacks common sense and the ring of truth.”
Agtual, who pleaded guilty to robbery, assault causing bodily harm and possession of marijuana of more than 30 grams, was sentenced to 24 months imprisonment.
In 2010, Agtual, who emigrated from the Philippines when he was eight years old, was convicted of possession of a restricted weapon and received a three year sentence, less a year credit for time already served.
